At Bottle Hero ApS, CVR no. 43483986, we place a high priority on privacy and data security. Unless otherwise stated, Bottle Hero ApS is the data controller for the processing of the activities described below.

This privacy policy applies to our processing of personal data collected from you when you make a purchase with us, use our website and social media pages, apply for a job and interact with us as a contact person for our B2B customers, suppliers and other partners.

The policy sets out guidelines for Bottle Hero's methods of processing your personal data and provides you with the information you are entitled to receive under applicable data protection laws.

The following section describes Bottle Hero's processing of personal data about visitors to www.bottlehero.dk as well as customers who make purchases via the website.

Collection of personal data

Bottle Hero may collect, process and store personal data about you in the following cases:

Bottle Hero may collect, process and store the following personal data about you:

In connection with purchases via the website (e.g. payment for purchases), you provide your card details. Bottle Hero does not store the card details but uses its business partners to process payments. The payment details are therefore stored and processed by the payment processor.

Basis for processing

Bottle Hero processes personal data on one or more of the following bases:

Performance of a contract: In some cases, the processing of personal data may be necessary in order to perform a contract between Bottle Hero and you, e.g. for purchases via the website (Article 6(1)(b) of the General Data Protection Regulation). Legitimate interests: The processing of personal data is based on our legitimate interests when we, for example, carry out statistics, analyses, marketing activities (that do not require consent), send customer satisfaction surveys, provide support and improve and develop our products and services (Article 6(1)(f) of the General Data Protection Regulation). Consent: Bottle Hero will only use your personal data to send you product information, newsletters and other marketing material by email if you have given your prior and explicit consent to this, unless applicable law permits us to contact you without such consent (Article 6(1)(a) of the General Data Protection Regulation). Legal obligation: In some cases, the processing of personal data may be necessary in order to comply with legal obligations, e.g. under the Danish Bookkeeping Act (Article 6(1)(c) of the General Data Protection Regulation). Legal requirements: Processing may also be necessary in order to prevent fraud or to establish, pursue or defend legal claims (Article 6(1)(f) and Article 9(2)(f) of the General Data Protection Regulation).

Retention period

Personal data collected in connection with your purchases is generally stored for 3 years from the last purchase.

Personal data included in accounting records is stored for 5 years from the end of the financial year, after which the data is deleted.

Documentation of your marketing consent is retained for 2 years from the time you have withdrawn your consent to receive direct marketing material.

However, we may retain the personal data for a longer period if required by law, or if it is necessary in order for a legal claim to be settled, established or defended. The data may also be processed and stored for longer in anonymised form.

If you are a visitor to or user of our social media pages

The following sections describe Bottle Hero's processing of personal data that you leave and/or provide when you visit Bottle Hero's social media pages, e.g. Bottle Hero's Facebook page (including Instagram) and LinkedIn ("social media"). This section supplements the general privacy policy developed by the individual social media companies.

Bottle Hero and the individual social media are joint data controllers for the processing of your personal data. Together with other companies, we continuously seek to maintain a dialogue with the social media about the regulation of joint data controllership. Depending on your behaviour on social media, Bottle Hero and social media companies may collect the following personal data about you:

Your "likes" or other reactions that you have expressed on the pages
Comments you write on the pages

Bottle Hero uses your personal data to improve Bottle Hero's products and services and to compile statistics. In this respect, Bottle Hero uses aggregated data from social media via their cookies, such as data on age, gender, marital status, occupation, lifestyle, areas of interest, as well as purchasing and geographical information.

Bottle Hero processes your personal data on the basis of Bottle Hero's legitimate interests in being able to improve Bottle Hero's products and services, cf. Article 6(1)(f) of the General Data Protection Regulation.

Under the General Data Protection Regulation, you have several rights, which you can read more about in section 5 of this policy. The general set-up of social media and the agreements entered into between Bottle Hero and the social media companies mean that you must contact the relevant social media companies if you wish to exercise your rights vis-à-vis the social media companies. This is because only the social media companies are functionally able to take the necessary steps to accommodate most of your requests.

If you are a job applicant

We process the personal data contained in your application and your CV, as well as any attached documents, in order to assess your application. If you are invited to an interview, we collect and evaluate the information you provide in that connection. The basis for our processing of your personal data is your application to enter into an employment contract with Bottle Hero, cf. Article 6(1)(b) of the General Data Protection Regulation, as well as our legitimate interests in processing information that you have provided to us yourself, cf. Article 6(1)(f) of the General Data Protection Regulation.

In addition, on the basis of the above, we may search the internet for relevant and available information, including content on social media. We will typically look for information about your previous employment, activity, skills and work performance.

If the position requires you to complete a personality test or similar, you will be informed of this once we have processed your application. The results of such tests are treated confidentially but are included in our assessment of your application. The results are deleted once the assessment has been completed. The basis for this processing is Article 6(1)(b) of the General Data Protection Regulation.

In some cases, you may also be asked to submit a copy of your criminal record, depending on the position in question. Such personal data is also treated confidentially. In such cases, we process the personal data on the basis of section 8(3) of the Danish Data Protection Act.

As part of our assessment of you and your application, we may obtain references from your former and/or current employers. We only collect references from persons you have named in your application or have provided to us. The basis for this processing is Article 6(1)(f) of the General Data Protection Regulation, or, if you have given your consent, Article 6(1)(a) of the General Data Protection Regulation.

We recommend that your application does not contain sensitive personal data, e.g. personal data revealing racial or ethnic background, religion, trade union membership, sexuality, health information, etc. If the position places special requirements on your physical health, we will (following a specific assessment) ask for your consent to process such personal data, cf. Article 6(1)(a) and Article 9(2)(a) of the General Data Protection Regulation.

If you are offered a position at Bottle Hero, your application and any additional relevant personal data collected in connection with the recruitment process will be stored in your personnel file with us.

If you are not offered a position, we retain your application and any additional personal data collected in connection with the recruitment process for a period of 12 months after our rejection, unless you have given your consent to a longer retention of such personal data.

If you are a contact person for Bottle Hero's B2B customers, suppliers and other business partners

This section describes Bottle Hero's policy for the processing of personal data collected from contact persons at Bottle Hero's B2B customers, suppliers and other business partners who cooperate with Bottle Hero.

Collection of personal data

Personal data about you will be collected in one or more of the following cases:

When your company or the company you are employed by enters into an agreement with Bottle Hero, including the purchase of products or services offered by Bottle Hero
When you have shown interest in Bottle Hero's products or services, e.g. by giving Bottle Hero your business card

Types of personal data

Bottle Hero may collect, process and store the following personal data:

Names, email addresses, telephone numbers and similar identifying information
Individual information, e.g. preferred languages.
Organisational information such as company name, company address, position, business area, primary place of work and country. Contractual information such as purchase orders, invoices, contracts and similar agreements between your company (or employer) and Bottle Hero, which may include your contact details.

Such information may be provided directly by you (primarily via emails and other correspondence) or by third parties such as your employer.

Bottle Hero processes your personal data on one or more of the following bases:

Performance of a contract: In some cases, it may be necessary to process personal data in order to perform a contract entered into between your company (or employer) and Bottle Hero, for example in connection with the handling of orders, administration of the cooperation, user accounts and profiles (Article 6(1)(b) of the General Data Protection Regulation). Retention period

Your personal data is stored for 3 years from the end of the cooperation. However, the data may be stored for longer in anonymised form.

Personal data included in accounting records, including documentation of orders, is stored for 5 years from the end of the financial year, after which the data is deleted.

Documentation of your marketing consent is retained for 2 years from the time you have withdrawn your consent to receive direct marketing material.

General information for everyone covered by this privacy policy

Disclosure to other data controllers and to data processors

In order to fulfil the above-mentioned purposes, we may give data processors access to your personal data. On the basis of an agreement with Bottle Hero, these data processors provide relevant services to Bottle Hero, including suppliers of, for example, IT services, CRM systems, invoicing systems, marketing services, customer satisfaction surveys, distribution of newsletters, website analytics, IT support, hosting providers, payment intermediaries, shipping providers, as well as other providers of systems or services. Such service providers only process personal data in accordance with our instructions and in accordance with the data processing agreements entered into.

At Bottle Hero, you can shop online from physical stores directly on our platform www.bottlehero.dk. In order for the stores to process and forward your order, your personal data is therefore disclosed to the stores/web shops that are to deliver your order. The stores are independent data controllers for the personal data, as they process the personal data for their own purposes.

In addition, in certain circumstances it may be necessary to disclose your personal data to the following other data controllers, e.g. distributors, including GLS (Article 6(1)(b) of the General Data Protection Regulation). Furthermore, Bottle Hero may in some cases be obliged, and in other cases entitled, to disclose your information to the authorities (Article 6(1)(c) of the General Data Protection Regulation). We may also disclose your personal data in order to establish, exercise or defend legal claims (Article 6(1)(f) and Article 9(2)(f) of the General Data Protection Regulation). In addition, we may also disclose your personal data to external auditors in order to comply with our audit obligation (Article 6(1)(c) of the General Data Protection Regulation).

In connection with Bottle Hero's development, the company structure may change, e.g. through a full or partial sale of Bottle Hero. In the event of a partial transfer of assets containing personal data, the basis for the associated disclosure of personal data is, as a general rule, Bottle Hero's legitimate interests in transferring parts of its assets and making commercial changes (Article 6(1)(f) of the General Data Protection Regulation).

If your personal data is transferred to data processors or data controllers established in countries outside the EU/EEA that do not have an adequate level of protection, such transfer will, as a general rule, be based on the European Commission's standard contractual clauses.
